MDC Systems® was hired by outside counsel to provide expert assistance in a matter involving the construction of a fiber optic highway extending through the states of Maryland, New Jersey, Pennsylvania and New York. The project owner andMDC Systems®‘ client was sued by the contractor for the following:
- failure to provide the necessary right-of-way,
- working in an out-of-sequence manner,
- extended contract time, and
- loss of productivity and other claims.
The Owner counterclaimed against the contractor for defective work, poor supervision and additional costs resulting from the contractor’s failures.
The case brought in Federal Court was placed on a rocket docket by the Magistrate for all discovery. MDC Systems® prepared a detailed expert report and provided deposition assistance substantiating the Owner’s position. MDC Systems® found that the contractor’s claims for inefficiency were solidly repudiated and led to a successful result for the Owner.
