Extended afternoon speaker, Mitchell Swann, PE, MDC Systems® Principal, gave the ASHRAE Distinguished Lecturer presentation at the ASHRAE Illinois Chapter at the University Center of Chicago (525 S. State Street, Chicago, IL 60605) on April 10th. Presenting on project risk issues once again, Mr. Swann led the ASHRAE audience through an interactive mock dispute.

“Can’t We All Just Get Along?” – Keeping Your Eye on the Prize Despite Getting Poked in It” (Alternative Dispute Resolution in Construction)
The construction industry has been a leading innovator in the use of Alternative Dispute Resolution (ADR) techniques to resolve disputes in on-going projects while keeping the project moving forward. These conflicts may arise out of an impromptu confluence of circumstance or have a formal pathway for resolution defined by the contract. This seminar will explain the core principles and practices of ADR with a special emphasis on contractual situations, such as construction, contract manufacturing and service outsourcing.
The seminar will be conducted by E. Mitchell Swann, MDC Systems, LLC, an ASHRAE Distinguished Lecturer with more than 20 years of experience in the areas of management, engineering and construction. Mr. Swann’s career has included dispute resolution, consultation, forensic analysis, engineering design, construction, commissioning, validation and troubleshooting for complex mechanical, instrumentation, electrical and control systems. He has authored several articles on issues in professional practice including the “Standard of Care and Consequential Damages” and is a co-author of the “ASHRAE Survival Guide to Design Build.”
